During a performance management meeting, Tasmin, an admin assistant, alleged that her manager ‘had it in for her’, as she had turned down his amorous advances and had since been sexually harassing her.
The client’s investigation of the grievance revealed that although the manager unwisely asked Tasmin out on a date when she first started, he hadn’t been sexually harassing her. In fact there is ample evidence of her poor performance justifying performance management.
The client required advice as to risks in making such findings, and assistance with the drafting of the grievance outcome letter. A barrister, from NoVate’s sister company No5 Chambers, was able to provide that advice, and drafted the outcome letter so that litigation exposure was limited.
